These terms and conditions apply when using or shopping at exuberate.no, and fulfill the general rules within applicable laws in Norway (Angrerettloven, forbrukerkjøpsloven, and personopplysningsloven). By accessing and using exuberate.no, as well as all exuberate offerings, you acknowledge that you have read and understood these terms and conditions. You agree to use our website and services solely for lawful purposes and in compliance with all applicable laws and regulations. You are also responsible for maintaining the confidentiality of your account and password and for restricting access to your devices. At the same time we would like to kindly remind you that you interact and treat everyone in the exuberate community with respect and dignity regardless of their background. By continuing to use exuberate’s products and services you agree to this commitment.

We would like to remind you that all material available, seen, or experienced on or through exuberate are either owned and trademarked by exuberate with all the rights being reserved or licensed via third parties. If you wish to re-use our material (Images, text, etc.), please contact us and we will guide you through the process. You are strictly prohibited to modify exuberate’s products and materials without permission.

Please note that value-added taxes (VAT) and customs duties may in most cases apply for deliveries, depending on the destination country. The prices shown on exuberate.no do not include VAT or duties *. VAT will be added during checkout for domestic customers (Customers located in Norway). For international customers (Customers located in all other countries besides Norway), they are responsible for paying any applicable taxes and duties upon or after receiving the items. VAT and duties are determined by local authorities. We are therefore not able to provide exact details. exuberate is only responsible for the transportation and delivery of the goods. It is also our customers’ responsibility to collect their packages. Our customers will be notified upon delivery. Shipping costs will also be added during checkout, unless stated otherwise. Fees may occur for any inconveniences caused, such as uncollected packages. All illustrations (Images, videos, and also description) must be considered as illustrations and are not and will not provide any guarantees for the products exact appearance or nature. In case there are any errors in the information, such as stock / inventory or price, exuberate will have the right to cancel the order. exuberate will not be held accountable for obtaining the item in case it is out of stock. Orders placed on exuberate.no may be canceled at any time, for any reason. A refund will be issued to the original payment method if the payment has gone through.

A purchase agreement is made between exuberate and the customer when a product is ordered. A confirmation will be sent to the given e-mail. We strongly recommend you keep your order confirmation; this is your proof of purchase / receipt. The agreement is first valid after receiving the order confirmation. By ordering, the customer accepts exuberate’s terms and conditions. exuberate accepts payments via major credit cards.

exuberate makes use of different shipping methods and logistics companies depending on the customer’s delivery address. Normal delivery time is 7-14 days (Unless delayed by unforeseen circumstances) from when the confirmation is sent by e-mail. If a shipment is delayed due to an unforeseen circumstance, you will be contacted. Complaints regarding damaged goods should be returned within «reasonable time». It is important that you inspect the shipment for any eventual damages as well as the condition of the products at the time of delivery. Uncollected packages will be sent back to exuberate. You will then be imposed a fee due to the costs that is brought to exuberate. The right to withdraw from a purchase will not be triggered if the customer does not collect the shipment.

According to the right of withdrawal act, you have as a customer fourteen (14) days to trigger this right from the moment the product is delivered to you. In case you are not satisfied with the purchase, kindly contact our customer support team to be guided through the return process. You will be provided a return slip *, that you will need to fill out and include in the package along with the returned items and the order confirmation (Receipt). On the return slip, kindly check the box stating whether your return is for a complete refund or an exchange of the product / product variant. The return address will be provided on the return slip, and we also recommend using a trackable shipping service.

Shipping charges applied to the original purchase are non-refundable. Additionally, the shipping costs for the returned items are also the responsibility of the customer and are non-refundable. Products sent in return for an exchange will be inspected and the new product(s) / product variant(s) will be sent to you free of charge. This service is only available for one instance. In case you decide to exchange the item(s) multiple times, you will need to cover the shipping charges from the second exchange onward. In case the new items have a lower price than the returned items, you will be refunded the difference. In case the new items have a higher price than the returned items, you will be refunded and you may place a new order for the new items. When we receive your return, we will inspect the returned items and let you know if a refund has been made or the reason it has not. Upon the return of promotional and / or discounted items, the paid amount will be considered. Upon the return of all the items in a single order that includes bonus products, the bonus products must also be included in the return. Refunds will only be processed to the payment method which was initially used for the purchase.

The right of withdrawal act applies under the condition that the shipments / packages / products are in an unchanged state, which means that the items must be unused and returned undamaged in their original packaging and the return must have been postmarked maximum fourteen (14) days after delivery. This also means that all tags, labels, and manuals must be included in the return. The items must not have been washed or tumble-dried, must not have any stains on them including stains from hygiene products, cannot have excessive human or animal hair on them, cannot have any abnormal or unnatural smells, as well as not have any «excessive» wrinkles. Hygiene products such as bottles, underwear, and socks cannot be returned.

To be eligible for a return, the item(s) must have been purchased directly from us and not through a third-party. Please ensure you keep the receipt as proof of purchase. Shipments can also be returned in case the items deviate from the agreement between both parties. Furthermore, the right to complain only covers original errors, and this right lasts for two (2) years from when the buyer claimed the product. Damaged products or products that deviate from our terms and guidelines will not be accepted and will be sent back to the buyer whom must also cover the shipping costs.

User generated content, such as reviews, ratings, personal information used for purchases, purchase history, and other data are owned by exuberate and will be used for i.e. research and development purposes and may also be altered or deleted. Please be responsible in generating content on our website. Be relevant and most importantly be honest; your reviews may affect other people’s decisions. When you write a review on exuberate.no, you give exuberate the right to use and publish these reviews through different media channels. exuberate will not be held responsible or liable for any damage done by the users themselves or as a result of the users’ activities. By uploading your photos on our social media channels and using our hashtags (Provided by us), you consent to exuberate using the photos for various purposes, including in marketing campaigns.

While we implement reasonable measures to filter information uploaded by our visitors (Such as customer reviews), exuberate will not be held accountable for any false information provided by our customers. We are required, by law, to reveal information about a user during a governmental or legal investigation. We will as such not be held responsible in doing so. We will also not be held accountable if a user shares their information with third parties, which may then result in leaked information. We will also not be held accountable if, as a result of any force majeure circumstance (Hacking, computer malfunction, etc.), a user’s personal information is changed or lost. Disclaimer: exuberate will not warrant that the platform will be error-free, secure, uninterrupted, or that any defects will be corrected.

exuberate offers an affiliate program designed to reward our partners for promoting our products. As an approved affiliate, you’ll gain access to a personalized affiliate dashboard within your user account, where you will find your unique referral link and key statistics. To be eligible for commission, your followers or audience must visit our website through your personalized affiliate link. For every sale made through this link, you will earn a commission. The exact commission percentage is mutually agreed upon between you and exuberate, and is formalized through a signed written agreement. Affiliate commissions are paid out once a month, typically on the 15th, or a day or two earlier depending on the calendar. Payouts are processed via PayPal or manual bank transfer, as specified in the agreement. Access to your affiliate dashboard becomes available once you have signed up and been approved to join the program.

exuberate gift cards are redeemable when purchasing merchandize at exuberate.no. The gift cards are also non-refundable and cannot be exchanged for cash. You are able to check the remaining balance on your gift cards that are connected to your user account. For the remaining balance on gift cards that are not connected to a user account, you may contact our customer service team and they will assist you momentarily.

In no event shall exuberate or its partners be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of our website, products, or services. You agree to indemnify and hold exuberate, its employees, and agents harmless from any claims, demands, or actions arising from your use of our website, products, services, or violation of these terms and conditions.

In case any unforeseen circumstances occur (Force majeure) that is beyond exuberate control, for example strike, change in law, war, natural disaster, or similar, the purchase agreement shall be delayed by exuberate for as long as these circumstances still apply. In case of any eventual twists, Norwegian law (The country in which exuberate operates in whole or partly) shall apply, and any disputes shall be subject to the exclusive jurisdiction of the courts in Norway.
